These terms and conditions ("Terms") govern your use of itifysolutions.online (the "Site"), operated by ITify Solutions, 80 S.W. 8th Street, 20th Floor, Miami, Florida 33130. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.
1. About the Site
The Site provides information about our IT services and products and a way to contact us. Information on the Site is a general description and does not form an offer or contract.
2. Services and products
- All services are provided under a separate written agreement, such as a master services agreement, statement of work or order form. If that agreement conflicts with these Terms, the agreement controls.
- Service descriptions, plan features and response targets on the Site are summaries. The specific scope, service levels, fees and term are set out in your proposal and agreement.
- Quotes are valid for the period stated on the quote, or 30 days if no period is stated, and may change if requirements or third-party pricing change.
- Third-party hardware and software are subject to the manufacturer's or publisher's own license terms and warranties. We pass through available warranties but do not add our own unless agreed in writing.
- Product availability, specifications and third-party pricing may change without notice.
3. Acceptable use
You agree not to:
- Use the Site for any unlawful purpose or in breach of these Terms.
- Attempt to gain unauthorized access to the Site, its servers or any connected system, or test its vulnerability without our written permission.
- Introduce malware or interfere with the Site's operation.
- Submit false information or impersonate another person or business.
- Scrape, copy or republish Site content for commercial purposes without permission.
4. Intellectual property
The Site's text, design, logo and layout are owned by ITify Solutions or used with permission. Photographs are licensed from Unsplash under the Unsplash License. Product names, logos and brands mentioned on the Site, including Microsoft, Google, Apple, Dell, HP and Lenovo, belong to their respective owners and are used only to describe compatible products and services. Their mention does not imply endorsement.
5. Communications
When you contact us through the Site, you consent to receive replies by email or phone. You can ask us to stop at any time. We will not send marketing text messages without your separate consent.
6. Disclaimer of warranties
The Site and its content are provided "as is" and "as available" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement. See our disclaimer for more detail.
7. Limitation of liability
To the fullest extent permitted by law, ITify Solutions will not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, data or business, arising from your use of or inability to use the Site. Our total liability for any claim relating to the Site will not exceed one hundred US dollars (US$100). Liability for services is governed solely by your service agreement.
8. Indemnification
You agree to indemnify and hold harmless ITify Solutions and its employees from claims, losses and expenses, including reasonable attorneys' fees, arising from your breach of these Terms or misuse of the Site.
9. Third-party links and content
Links to third-party websites, and embedded third-party content such as maps, are provided for convenience. We do not control and are not responsible for them.
10. Governing law and venue
These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law rules. Any dispute relating to these Terms or the Site will be brought exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to their jurisdiction.
11. Changes
We may update these Terms at any time by posting a revised version on the Site. Continued use after changes take effect means you accept the revised Terms.
12. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
